CaterSpot and our affiliates and partners provide our services to you subject to the following notices, terms, and conditions and to our Privacy Policy (together, our Agreement). When you use any CaterSpot service or fulfill any CaterSpot orders, you are subject to all governing laws, and all applicable rules, policies, terms, and conditions. www.caterspot.com (The Website) is a portal to facilitate catering services from selected caterers ("PARTNER CATERERS") and to arrange the conclusion of respective contracts. CaterSpot does not itself offer the catering services presented on the Website. CaterSpot is merely facilitating the services of PARTNER CATERERS and may assist with the logistics of the order. The PARTNER CATERER is exclusively responsible for ordered catering services.

Agreement with Terms

By using this website or working with our employees or agents by any means (including telephone, text, email, chat, or any other mechanism), you accept our Agreement. We reserve the right to make changes to our website, our services, and the Agreement at any time. Your use of our services after any changes have been made constitutes acceptance of the changes. In addition to these Terms, the terms and conditions of the chosen PARTNER CATERER apply. The respective PARTNER CATERER's terms and conditions are available on the Website and during the order process.

Customers' duties and obligations

All Customers using CaterSpot's service must

  • be at least 18 years old to use CaterSpot's service;
  • be able to physically receive orders at the address designated in the order process;
  • not offer in any manner, sub-license or re-sell CaterSpot's service, grant use of or access to the services to a third party, for any reason whatsoever without CaterSpot's prior written consent;
  • provide true, accurate, and current data;
  • update Customer's account in case of changes to Customer's registered data;
  • use all reasonable efforts to keep their credentials confidential and must inform CaterSpot if customer suspects or discovers that the password has become known to someone else;

Registration

To place orders, Customers are required to register. Customers can register during the order process or independently thereof. Acceptance of the registration is subject to the sole discretion of CaterSpot. In case of an application's acceptance a Customer profile will be created. Customers may not impersonate any person or entity or misrepresent identities or misleadingly enter affiliations with any person or entity. This includes using another person's username, password, or other account information.

Order process

Customers may place an order request by using CaterSpot's menu on the Website. Each order request will specify the PARTNER CATERER, the meals, the amount of meals, the applied price and delivery info including time and location of desired delivery. The details of an order can be negotiated with CaterSpot.

After placing an order, Customer will receive an email from CaterSpot acknowledging that Customer's order had been received and CaterSpot's PARTNER CATERER will evaluate the order. Please note that this does not mean that an order has been accepted. All orders are subject to acceptance by respective Partner Caterers.

If our PARTNER CATERER confirms Customers' order to us, Customers will receive an email by CaterSpot on behalf of the PARTNER CATERER, ("Confirmation Email") confirming Customers' order has been accepted. The contract between Customers and the PARTNER CATERER is only formed when a Confirmation Email has been sent out.

The contract for the order of catering services is formed between Customers and our PARTNER CATERER only. CaterSpot will not become a party of the contract. The food provided for the Customer's order is in the sole responsibility of the PARTNER CATERER accepting the order. CaterSpot may assist only in transporting that food.

Cancellation

Customer may cancel an order before the stated cancellation period. The cancellation period may vary by vendor. Once the cancellation period has passed, the order payment will not be refundable. For further questions on this the Customer may email us at support@caterspot.com.

Meals

Meals can be chosen from the range offered on the Website. Any pictures used on the Website are exemplary; the actual appearance of meals may differ.

Meals may contain allergens. For further information about allergens, please contact the PARTNER CATERER you order is placed with.

If Customers order any alcoholic beverages, Customers must be at least of the age of 18. PARTNER CATERERS reserve the right to deny the delivery of alcoholic beverages in case that the recipient cannot prove that to be of legal age.

Ownership and Use of Website, Copyright and Trademarks

This website is the sole property of CaterSpot or our affiliates, partners or content suppliers and is protected by international copyright laws. The compilation (meaning the collection, arrangement, and assembly) of all content on this website, the content, and all software used on this website, are the exclusive property of CaterSpot or our affiliates or partners and are protected by international copyright laws. Title to any part of this property shall not pass to you or to any other person or entity.

This website, compilation, content and software may only be used as a personal e-commerce resource. Any other use, including the reproduction, modification, distribution, transmission, republication, display, sale, resale, unauthorized use, or other exploitation of any part of the website, compilation, content and software without express prior written permission from CaterSpot is strictly prohibited, may violate copyright, trademark and other laws, and may result in your being responsible for any and all associated damages. If you post names of, reviews of, or comments on products or companies on CaterSpot's website, you grant CaterSpot and our affiliates and partners a non-exclusive, royalty-free, and fully sub-licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such names, reviews, and comments throughout the world in any media. You also grant CaterSpot and our affiliates and partners the right to use the name (if any) that you submit with any name, review or comment in connection with such review or comment.

If you allow us to post your menu, pricing, logo, or other information on our website, you grant CaterSpot and our affiliates and partners a non-exclusive, royalty-free, perpetual, irrevocable, and fully sub-licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such menu, pricing, logo, or other information throughout the world in any media, subject to our usage of your trade or service marks as specified elsewhere in these Terms.

Risk of Loss; Guarantee

All items purchased through CaterSpot are made pursuant to a fulfillment agreement with one or more third parties (such as food providers or delivery companies). Should there be errors, CaterSpot will offer every reasonable assistance in the correction of that error. In any event, however, the risk of loss and title for such items pass to you upon our conveyance of your order to the third party/ies. It may be necessary for you to file claims with those parties.

Indemnification

You and your employer (if any) agree to indemnify and hold CaterSpot, our subsidiaries, affiliates, officers, agents, and other partners and employees harmless from any loss, liability, damage, claim, or demand, including reasonable attorneys' fees, made by any party due to or arising out of (a) your use of this website or any CaterSpot services in any way, or (b) your fulfillment or attempted fulfillment of any orders sent to you by CaterSpot, or (c) any other engagement or attempted engagement with CaterSpot.

CaterSpot reserves the right to limit purchases and purchase quantities. In the event of any site error, you may be limited to a single unit purchase. Pricing on this site is subject to change without notice.

No Agency Relationship

You agree that we are not responsible for any information you convey, in any manner, and that we have no control over any actions you take or statements you make. You agree that you and we are independent contractors, and that neither you nor we are in any way an agent for the other party.
